Terms and conditions for using goldenmatrixium services

By accessing and using the goldenmatrixium website and services, you accept and agree to be bound by these Terms of Service. These terms apply to all users of our website and clients of our strength equipment ROI analysis services. If you do not agree to these terms, please do not use our website or services. goldenmatrixium AS (CVR51428802) reserves the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any modifications.
goldenmatrixium provides professional strength equipment ROI analysis services for fitness facilities. Our services include equipment performance analysis, financial ROI calculations, investment optimisation recommendations, strategic reporting, and ongoing consultation. All analysis and recommendations are provided based on data and information supplied by the client and are intended for business decision-making purposes. We do not guarantee specific financial outcomes or returns on investment.
As a user of our services, you agree to provide accurate, complete, and current information when requested. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to use our services only for lawful purposes and in accordance with these terms. You must not attempt to gain unauthorised access to our systems, interfere with the proper functioning of our website, or engage in any activity that could damage or impair our services.
Clients engaging our analysis services are responsible for providing accurate and complete data about their fitness facilities and equipment. This includes usage data, financial records, maintenance logs, and any other information necessary for comprehensive analysis. Clients must ensure they have the right to share all provided data and that such sharing complies with applicable privacy and data protection laws. Failure to provide accurate or complete information may affect the quality and reliability of our analysis.
All content on the goldenmatrixium website, including text, graphics, logos, images, and software, is the property of goldenmatrixium AS and is protected by Danish and international copyright laws. Our analysis methodologies, report formats, and proprietary tools are confidential and proprietary to goldenmatrixium. Clients receive a licence to use analysis reports for their internal business purposes but may not reproduce, distribute, or create derivative works from our proprietary methodologies without written permission.
We understand that clients may share sensitive business information during the analysis process. goldenmatrixium agrees to maintain strict confidentiality regarding all client data and information. We will not disclose client information to third parties without explicit consent, except as required by law. Similarly, clients agree to maintain confidentiality regarding our proprietary analysis methods and tools. This confidentiality obligation survives termination of our service agreement.
goldenmatrixium provides analysis and recommendations based on available data and industry best practices. However, business decisions and their outcomes remain the sole responsibility of the client. To the maximum extent permitted by Danish law, goldenmatrixium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities. Our total liability for any claim arising from our services shall not exceed the fees paid by the client for the specific service giving rise to the claim.
While we strive to maintain continuous website availability, goldenmatrixium does not guarantee uninterrupted access to our website or services. We may temporarily suspend access for maintenance, updates, or technical issues. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to existing clients.
Payment terms for analysis services are specified in individual service agreements. Unless otherwise agreed, payment is due within 30 days of invoice date. Late payments may incur additional charges as permitted by Danish law. goldenmatrixium reserves the right to suspend services for accounts with overdue payments. All fees are exclusive of applicable taxes, which are the client's responsibility.
These Terms of Service are governed by and construed in accordance with Danish law. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Danish courts. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Either party may terminate a service agreement with 30 days' written notice. goldenmatrixium may terminate services immediately if a client breaches these terms or fails to pay fees when due. Upon termination, clients must cease using any proprietary tools or methods and return or destroy any confidential materials. Provisions regarding confidentiality, intellectual property, and limitation of liability shall survive termination.
We encourage clients to contact us directly to resolve any concerns or disputes. If a dispute cannot be resolved through direct communication, we agree to participate in mediation before pursuing formal legal proceedings. Any mediation shall be conducted in Denmark according to Danish mediation procedures.
